Digital Millennium Copyright Act (DMCA) Policy
Geek Vibes Nation (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of https://geekvibesnation.com (the “Site”) to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), Title 17, United States Code, Section 512, we respond promptly to properly submitted notices of alleged copyright infringement.
Designated DMCA Agent
All claims of copyright infringement must be submitted in writing to our designated DMCA agent via our Contact page. For faster processing, email submission is strongly recommended.
Filing a DMCA Takedown Notice
If you are a copyright owner, or authorized to act on behalf of one, please provide a written notice that includes the following information (as required by 17 U.S.C. §512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved);
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (including the exact URL);
- Your contact information, including full legal name, mailing address, telephone number, and email address;
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Important Notice
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees.
Counter-Notification Procedure
If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our DMCA agent that includes the following (pursuant to 17 U.S.C. §512(g)(3)):
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location where it appeared before removal (include the URL);
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal district court in your district (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
Upon receipt of a valid counter-notification, we may restore the removed material in accordance with the DMCA, unless the original claimant files a court action seeking a restraining order.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the Site and/or terminate accounts of users who infringe any intellectual property rights of others, whether or not there is repeat infringement.
Standard Technical Measures
We accommodate and do not interfere with standard technical measures used by copyright owners to protect their works, as defined under 17 U.S.C. §512(i).
Good Faith Handling and Discretion
We reserve the right to remove or disable access to any material alleged to be infringing without prior notice and at our sole discretion. We also reserve the right to terminate user access for any reason, including but not limited to repeated infringement.
Modifications
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting. Continued use of the Site constitutes acceptance of any updated terms.
